JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2020 The petitioner seeks bail in connection with Uchkagaon P.S. Case No. 143 of 2019 instituted for the offences under Sections 341, 323, 307, 302, 447, 504, 506/34 of the Indian Penal Code.

One Shankar Sahani is stated to have been killed by other accused persons. The informant who is brother of the deceased is stated to have been assaulted by the petitioner, Jyotish Sahani and Pola Sahani. There is no injury report on record so far as the informant is concerned. Co-accused Pola Sahani having similar allegation against him as that of the petitioner has been granted bail by a Co-ordinate Bench of this

Considering the aforestated facts and taking into account the period of custody of the petitioner which is from 25.11.2019, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gopalganj in connection with Uchkagaon P.S. Case No. 143 of 2019.
