All sections are bailable in nature except section 379 of the Indian Penal Code as well as section 3 (X) of the SC/ST (Prevention of Atrocities) Act, 1989.

It would appear that a dispute arose between the parties on account of irrigating the field and not due to caste of the informant and, therefore, application of section SC/ST (Prevention of Atrocities) Act in the present case appears to be doubtful. Accordingly, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Danapur in Bihta P.S. Case no.
