JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,420,468,470,471 and 477A of the Indian Penal Code.
The prosecution case is that the petitioner being Branch Manager of SBI, Ghoshi branch, cashier Dharmendra Kumar along with Darvesh Singh, the proprietor of M/s Prince Enterprises in connivance withdrew Rs.35000/- of KCC and Rs.100000/- sanctioned for power tiller, total Rs.1,35000/- in the name of the informant Satya Narayan Singh and transferred in the account of Darvesh Kumar.
It is submitted by the learned counsel for the petitioner that the aforesaid amount was transferred in the account of
Patna High Court Cr.Misc. No.8803 of 2016 (2) dt.24-02-2016 2/2 Darvesh Kumar under a bonafide mistake but now the total amount has been reverted back in the account of the informant and cashier of the bank has been granted anticipatory bail vide Cr. Misc. No. 1025 of 2015 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad in connection with Ghosi P.S. Case No.271 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bonds of the petitioner will be accepted by the learned court below on verification of the fact that the total amount has already been transferred in the account of the informant.
