The petitioner apprehends his arrest in connection with Motihari Muffasil P.S. Case No. 96 of 2014 registered for the offence under Sections-413, 414 of the Indian Penal Code. Admittedly, nothing has been recovered from conscious possession of the petitioner and the name of the petitioner came in confessional statement of those accused persons who were arrested by the informant with stolen motorcycle. Moreover, the aforesaid apprehended accused persons disclosed only the fact that they were going to sell the stolen motorcycle to the petitioner and one other. Paragraph-3 of the petitioner reveals
Patna High Court Cr.Misc. No.12306 of 2015 (2) dt.05-05-2015 2/2 that the petitioner does not have any criminal antecedent. Accordingly, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Motihari Muffasil P.S. Case No. 96 of 2014 to the satisfaction of learned Sub Divisional Judicial Magistrate, Motihari, East Champaran subject to conditions as laid down u/S 438(2) of the Cr. P.C.
