JUSTICE ARUN KUMAR ORAL ORDER 15-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Gaya Rail PS Case No. 224 of 2017 registered under Section 379 of the IPC. The allegation in brief is that the informant, a Railway Guard, while going with a goods train on the signal three persons scaled his boggie, robbed him of his purse, mobile and chain, later on the looted mobile was recovered from the possession of the petitioner.
Learned Counsel for the petitioner submits that the petitioner was not put on TIP though recovery is said to be made from his possession, he has no criminal antecedent and is in custody since 1.12.2017.
Having considered the said facts and circumstances, the petitioner, namely, Mantu Kumar @ Mantu Kumar Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Railway, Gaya in connection with Gaya Rail PS Case No. 224 of 2017.
