The present petition has been filed for modification of order dated 17.11.2017 passed in Cr. Misc. No. 37236/2017 to the extent that provisional bail granted to the petitioner may be confirmed and the amount of interim maintenance may be reduced.

Learned counsel for the petitioner has submitted that petitioner is making payment of amount of Rs. 7,500/- in compliance of the order of this Court.

This Court has observed in the order dated 17.11.2017 that petitioner will make payment of Rs. 7,500/- per

Patna High Court CR. MISC. No.15677 of 2019(2) dt.27-03-2019 2/2 month to the O.P. No. 2-wife for maintenance till final order is passed in the maintenance case. After passing of final order in the maintenance case, the Court below will confirm the provisional bail of the petitioner. The Court below will pass final order in maintenance case within one year from the receipt of this order.

It has been submitted that final order has not been passed in maintenance case till date.

This modification petition is accordingly disposed off with direction to the Court below to pass final order in the pending maintenance case within a period of three months from the date of receipt of this order and send compliance report to this Court otherwise serious view will be taken in the matter.
