KUMAR ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 120 (B)/34 of the I.P.C. and u/S 27 of the Arms Act. Allegation against the petitioner is that he had accompanied the deceased who is the husband of the informant. The petitioner and the deceased were sitting in a tea stall where six persons arrived on the motorcycles and took out the pistol from their respective waist and fired upon the husband of the informant, which led to his death.

It has been submitted on behalf of the petitioner that there is no specific allegation against the petitioner. Further, the other accused person has been granted bail and the case of this petitioner is on similar footing. He is in custody since 19.08.2016.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M.
