Petitioner seeks regular bail in connection with Kathaiya P.S. Case No.26 of 2008 registered for the alleged offences under Sections 304 (B)/34 of the Indian Penal Code. As per the prosecution case, the informant's daughter along with her children were set ablaze by her in-laws for non fulfillment of dowry demand of motorcycle and golden chain. It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. He has been falsely implicated in this case. The petitioner happens to be the brother-in-law of the deceased and living separately. He has no concern with affairs of the deceased's family. He is not named in the F.I.R. rather his name surfaced in

Patna High Court Cr.Misc. No.29511 of 2017 (02) dt.01-07-2017 2/2 the case eight years later during the course of investigation. The allegations levelled against the petitioner are general and omnibus in nature. He has been languishing in jail custody since 09.03.2017.

In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Kathaiya P.S. Case No.26 of 2008.
