The petitioner seeks regular bail in connection with Sessions Trial No. 717 of 2018 arising out of Sakra P.S. Case No. 448 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code.

The allegation is regarding unknown miscreants having broken A.T.M. machine and having stolen the same. The learned counsel for the petitioner submits that the name of the petitioner has transpired during the course of confessional statement made by the co-accused person, namely, Ramu Sahni, however, neither any recovery has been made from the possession of the petitioner nor any recovery has been made from his house. It is submitted that the petitioner is languishing in custody since 17.07.2018. Lastly, it is submitted that similarly situated coaccused person has been granted bail by an order dated 23.01.2019 passed in Criminal Misc. No. 8954 of 2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Sessions Judge, Muzaffarpur in connection with Sessions Trial No. 717 of 2018 arising out of Sakara P.S.
