JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,324 and 307 of the Indian Penal Code. The prosecution case is that Suraj Saini and Mohan Prasad were quarreling with the husband of the informant when the petitioner being son of Suraj Saini assaulted the husband of the informant namely Ghanshyam Dubey on his back. It is submitted by the learned counsel for the petitioner that due to petty dispute the accusation has been levelled. Even assuming the accusation, the petitioner had no intention to kill the husband of the informant.
It is submitted by learned counsel for the informant that
Patna High Court Cr.Misc. No.8839 of 2016 (2) dt.25-02-2016 2/2 due to assault made by the petitioner the husband of the informant sustained grievous injury.
Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Dumraon P.S. Case No. 326 of 2015 pending in the court of learned C.J.M. Buxar. This application is disposed of with the aforesaid observation/direction.
