Petitioner is languishing in custody since 20.04.2017 in connection with Pipra P.S. Case No. 74/2017 for offences punishable under Sections 25(1-b) A, 26 of the Arms Act. The prosecution case, as lodged by the police personnel, is that on secret information they conducted a raid and apprehended two persons including the petitioner. It is alleged that eight cartridges and mobile phones were recovered from the possession of other co-accused, two cartridges including one live was recovered from the possession of the petitioner. Accordingly, a seizure-list was prepared.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.34992 of 2017 (2) dt.11-08-2017 2/2 petitioner that he is innocent, bears no criminal antecedent and no overt act has been alleged to have committed by the petitioner. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Pipra P.S. Case No. 74/2017.
