Petitioner seeks regular bail in Phulwaria P.S. Case No.209 of 2017 instituted for the offence under Sections 302, 201, 120B of I.P.C.
Informant is the sister of the deceased who in the F.I.R. has stated that her sister-in-law (bhabhi), Nagma Khatoon, had illicit relation with one Amirul and she has solemnized second marriage with him while his brother was living abroad and when he came to know he came back and asked Nagma to return the land and a house constructed by the fund provided by the deceased brother. It has further been contended that the deceased was murdered and her dead body was thrown in septic tank which was
Patna High Court Cr.Misc. No.2108 of 2018 (3) dt.08-02-2018 2/2 subsequently recovered by the police.
It has been submitted by the petitioner that there is general and omnibus allegation against the petitioner and there is no allegation of any specific overt act against her. She cannot be alleged to have committed murder of the deceased. Petitioner has clean antecedent and she is in custody since 23.10.2017. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M. XIII, Gopalganj, in Phulwaria P.S.Case No.209 of 2017.
