Mr.Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act and Sections 272 and 273/34 of the Indian Penal Code.

Prosecution case is that 272.25 liters illegal liquor was recovered from Mango orchard of one Ram Singh. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has been made accused only on suspicion and bears clean antecedent. Considering the facts of the case, this pre-arrest bail petition is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand)

Patna High Court CR. MISC. No.13656 of 2023(3) dt.26-06-2023 2/2 with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Court No. 1, Samastipur in Rosera Police Station Case No. 98 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
