In this case, the petitioner is seeking regular bail in connection with Bhagwanpur P.S. Case No. 206 of 2018 registered for offence punishable under sections 394 and 302 of the Indian Penal Code.
In the FIR it has been alleged that the petitioner entered into the office of the informant's brother and committed robbery and in course of that the petitioner has killed the younger brother of the informant and also took away a golden chain and a mobile bearing no. 8873966471 and also Rs.2,00,000/-. The petitioner has criminal history. Learned counsel for the petitioner submits that save and except the confessional statement, there is nothing on record
Patna High Court CR. MISC. No.10881 of 2020(5) dt.22-01-2021 2/2 against the petitioner, but in paragraph 44 and in paragraph 45 of the case diary, the witnesses Bhikhari Sahani and Sanjay Sahani have given their statement and taken the name of the petitioner to be involved in the said incident. He further submits that co-accused Rakesh Kumar has been granted bail by one of the coordinate Bench of this Court in Cr. Misc. No. 27906 of 2020, but from perusal of the order dated 15.12.2020 passed in that case it appears that the different paragraphs of the case diary were not brought to notice of the Court. In such view of the matter, this Court is not inclined to grant bail to the petitioner for the present and accordingly his prayer for bail is rejected.
