JUSTICE ANIL KUMAR SINHA ORAL ORDER 03-01-2023 The petitioner has approached this court against the order dated 13.09.2011 by which contractual services of the petitioner as Panchayat Rojgar Sevak has been terminated vide Memo No. 3156/D.R.D.A. dated 13.09.2011 passed by Deputy Development Commissioner, West Champaran, Bettiah. Learned counsel for the State submits that the petitioner has raised a whole lot of dispute in his reply to the show-cause and there is an alternative remedy of appeal under the scheme where District Magistrate is the Appellate Authority.
Patna High Court CWJC No.14313 of 2013(2) dt.03-01-2023 2/2 In view of the aforesaid submission and taking into the consideration the disputes involved in this case, this writ application is disposed of with liberty to the petitioner to file an appeal before the District Magistrate-cum-District Programme Coordinator, West Champaran at Bettiah.
If the appeal is filed by the petitioner within a period of two weeks, the District Magistrate-cum-District Programme Coordinator, West Champaran at Bettiah shall be obliged to dispose the same in accordance with law by a reasoned order. It is expected that the appeal filed by the petitioner shall be disposed by the District Magistrate, West Champaran expeditiously, preferably within a period of three months.
