1. Heard Sri Amit Shrivastava, learned Senior Counsel for the petitioner, Sri Md. Arif, learned A.P.P. for the State and Ms. Swati Parmar, learned counsel appearing on behalf of the informant.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. Learned Senior Counsel for the petitioner submits that the instant regular bail application has been filed in view of the liberty granted to the petitioner by an order dated 17.01.2025 passed in Cr. Misc. No. 77660 of 2024 to renew his prayer for bail after framing of charge.
4. Learned Senior Counsel for the petitioner submits
Patna High Court CR. MISC. No.11807 of 2025(2) dt.05-03-2025 2/2 that charges against the petitioner have been framed by an order dated 23.01.2025 as would manifest from Annexure-5 to the bail application at page 29.
5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant vehemently opposed the prayer for regular bail of the petitioner.
6. Considering the submissions made by the learned Senior Counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Sessions Trial No. 1303 of 2024 arising out of Gopalpur P.S. Case No. 773 of 2023.
7. However, it is made clear that if the learned trial court comes to a conclusion that petitioner, after his release on bail, is trying to delay the trial of the case in any manner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
