Petitioner seeks modification of the order dated 02.08.2017 passed in Cri. Misc. No. 35037 of 2017 stating therein that neither the plea had been made nor it borne out from his application that charge-sheet had been submitted but it has been noted in the order that charge-sheet has already been submitted. A letter no. 1262 dated 05.07.2017 has been received from the District and Sessions Judge, East Champaran, Motihari that no charge-sheet has been submitted in this case by the police. The matter was heard on merits and privilege of bail was granted to the petitioner. Hence, in the interest of justice, the lines, "charge-sheet has already been submitted and there is no
Patna High Court Cr.Misc. No.35037 of 2017 (3) dt.09-08-2017 2/2 allegation that petitioner has tampered with the prosecution witnesses" be deleted.
The order dated 02.08.2017 is modified to the extent indicated above.
