JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-08-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Lalganj P.S. Case No. 278/2019 registered for the offences punishable under Section 414/34 of the Indian Penal Code and Section 25(1-b)a26/35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner was not arrested on the spot and it is alleged that he had fled away taking advantage of darkness. Police has shown recovery of one loaded country made pistol and a live cartridge from the motorcycle which was allegedly left by the

The co-accused Arun Rai @ Arun Ray has been granted bail by learned coordinate Bench of this Court in Cr. Misc. No. 13954/2021. Petitioner has got one criminal antecedent but he is said to be on bail. Learned A.P.P. for the State has though opposed the prayer for regular bail of the petitioner, considering the facts and circumstances of the case and that the petitioner has remained in custody for about eight months in connection with this case and he has got one criminal antecedent in which he is said to be on bail, this Court directs release of the petitioner above named on bail on furnishing of bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Hajipur, Vaishali in connection with Lalganj P.S. Case No. 278 of 2019, subject to the condition as laid down under Section 437 (3) Cr.P.C.

And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned
