Petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Section 498A of the I.P.C and Section 3⁄4 of the Dowry Prohibition Act.
The basic accusation is torture for nonfulfilment of dowry demand. The petitioner has renewed his prayer for anticipatory bail as earlier anticipatory bail application of the petitioner was rejected vice order dated 30.04.2009 passed in Cr. Misc. No. 14807 of 2009.
It is submitted by learned counsel for the petitioner that petitioner is ready to reconcile the issue. Though this Court is not inclined to
Patna High Court Cr.Misc. No.6549 of 2015 (2) dt.03-03-2015 2/2 entertain the second anticipatory bail application but considering the present stand of the petitioner, let learned Court below issue notice to the informant and on her appearance make an effort to reconcile the issue and till then learned Court below may not take coercive steps against the petitioner.
Accordingly the application is disposed off in connection with Nawada P.S. Case No. 253 of 2008, pending in the Court of learned Chief Judicial Magistrate, Nawada. (Dinesh Kumar Singh, J) Shageer/- U T
