The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the informant being the Tax Collector was posted on Chauparan Check Post. On 29.03.2015 at 6.00 P.M. the informant was going on her vehicle, in the meantime Sikander Khan including the petitioner with two unknown surrounded her. Sikander Khan fired on the informant, she received injury on her left hand finger. The motive of the occurrence is that accused use to pressurise the informant to allow the vehicle to cross
Patna High Court Cr.Misc. No.8823 of 2016 (2) dt.25-02-2016 the boarder without payment of taxes.
It is submitted by the learned counsel for the petitioner that though the injury was found grievous, but caused by Sikandar Khan. No overt act has been alleged against the petitioner. The petitioner is accused in one another case in which he is on bail.
Considering the thrust of accusation is against coaccused Sikandar Khan, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Ramgarh Chowk) P.S. Case No. 233 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
