KUMAR ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Sessions Trial no. 656 of 2017 arising out of Masaurhi P. S. Case no. 229 of 2017 registered for the offences punishable under Sections 302 and 201of the Indian Penal Code. Allegation is that son of informant after coming from police station at 3 A.M. asked his wife to prepare tea. In the meantime he received mobile call and said that he was going to attend duty. Thereafter, informant got information that his son's dead body was lying in police station which was found thrown near Nag Asthan village by the side of road.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. He is not named in the F.I.R. His name has surfaced during investigation only on

Patna High Court Cr.Misc. No.6150 of 2018(3) dt.27-02-2018 2/2 suspicion. Petitioner has got no criminal antecedent. He is in custody since 26.6.2017. It has further been stated that one coaccused Abhishek Kumar has been granted anticipatory bail by a Bench of this Court vide Cr. Misc. no. 6253 of 2018 and two others have been granted regular bail as contained in Annexure4 of this petition. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-XIII, Patna, in connection with Sessions Trial No. 656 of 2017 arising out of Masaurhi P.S. Case no. 229 of 2017.
