The petitioner seeks regular bail in connection with Siwan Town PS case no. 59 of 2017 registered for the offences punishable under Sections 399, 402/34 of Indian Penal Code and Sections 25(1-b), 26, 35 of Arms Act.

The allegation leveled by the informant is that a secret information was received that some people were conspiring to conduct dacoity. Thereupon, the police team had reached near Hanuman temple where 5-6 persons were present however, upon seeing police party, they started fleeing away but two persons are said to have been apprehended who had told the name of the petitioner as one of the person who had fled away from place of occurrence upon seeing police party.

No.29040 of 2017 (2) dt.01-07-2017 2/2 Learned counsel for the petitioner submits that that the petitioner is of tender age, he has been merely implicated upon the instance of other main accused persons, no recovery has been made from his possession and he is in custody since 22.04.2017. Learned counsel for petitioner further submits that though he is an accused in one another case but he has already been granted anticipatory bail in that case.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to direct the petitioner to be released on regular bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Siwan Town PS case no. 59 of 2017.
