The petitioner is apprehending his arrest in connection with Madanpur P.S. Case No. 322 of 2021 pending in the Court of learned Special Judge, Excise-I, Aurangabad (Bihar) in a case registered for the offences punishable under Sections 30(a) and 33 of the Bihar Prohibition and Excise (Amendment) Act, 2018.
It is a case of recovery of country made liquor from a Bolero vehicle bearing Registration No. JH-01AD-3945 which belongs to the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has got clean antecedent.
Patna High Court CR. MISC. No.13037 of 2022(2) dt.05-08-2022 2/2 Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In view of the fact that the country made liquor was recovered from the said vehicle of this petitioner, as such, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
