Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.

The victim-lady died within few years of her marriage in matrimonial house in unnatural circumstances and the dead body was hurriedly disposed of without information to the police or her near relations. There is allegation of demand of dowry and torture for the same soon before the death. Submission of the learned counsel for the petitioner is that the petitioner is in custody since 04.02.2017. The allegation is general and omnibus against the petitioner as well as other family members who have already been allowed

Patna High Court Cr.Misc. No.25220 of 2017 (3) dt.29-06-2017 2/2 bail by different Benches of this Hon'ble Court and the petitioner is ready to fully cooperate with the trial of this case. Considering the nature of allegation and responsibility of the petitioner towards the victim, I am not inclined to enlarge him on bail for the present in connection with Sikta Police Station Case No. 45 of 2016 pending in the court of learned 3rd Additional Chief Judicial Magistrate, Bettiah, West Champaran.

Hence, prayer for bail is refused.

However, the learned court below is directed to expedite the trial.
