The petitioner seeks bail in connection with Spl. P.S. Case No. 721 of 2017 (arising out of Sadar P.S. Case No. 198 of 2017) registered for the offences under Sections 272, 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition Excise Act, 2016.

As per prosecution case, Rs. 1,16,000/- was seized from the possession of the petitioner and other accused persons which the petitioner had obtained by vending the liquor to some other persons and on the statement of the petitioner 49 lts. foreign liquor was recovered from possession of other accused persons. It is submitted by learned counsel for the petitioner that

No illicit liquor has been recovered from his conscious possession. His elder brother had taken debt for marriage purposes of his daughter from the father-in-law of the petitioner and the petitioner was going to return the said money to his father-in-law. The petitioner is languishing in jail custody since 20.04.2017. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd A.D.J.-cum-Spl. Excise Judge, Purnea in connection with Spl. P.S. Case No. 721 of 2017 (arising out of Sadar P.S. Case No. 198 of 2017). (Prakash Chandra Jaiswal, J) rohit/- U T
