JUSTICE PRABHAT KUMAR JHA ORAL ORDER 02-12-2020 Heard Mr. Rama Kant Sharma, learned senior counsel for the petitioner, Mr.Arvind Kumar, learned counsel for the Vigilance and Mr. Ajay Mishra, learned counsel for the State through Video Conferencing.

Petitioner seeks bail in Agamkuan P.S. Case No.44 of 2017 registered under Sections 419, 420, 467, 468, 471 and 34 of the IPC. Later on Section 120(B) of the I.P.C., Section 66(B) of the I.T. Act as well as Sections 7, 8, 9, 13(i)(c)(d)(e) read with Section 13(2) of the Prevention of Corruption Act were added.

The prayer for bail of the petitioner was earlier twice rejected by this Court. On the last occasion, the prayer for bail of the petitioner was rejected on 04.09.2019 vide order passed in Cr.Misc.No.10690 of 2019. The petitioner was the Secretary of Bihar Staff Selection Commission and during course of

Patna High Court CR. MISC. No.20947 of 2020(2) dt.02-12-2020 2/2 investigation, the material against the petitioner has come that the petitioner was also found involved in leaking the question papers.

It is submitted that Sudhir Kumar (Chairman of Bihar Staff Selection Commission) has already been granted bail by the Hon'ble Supreme Court vide order passed in Petition for Special Leave to Appeal (Crl.) No.3441 of 2020 on the ground that he remained in jail for three years and seven months and there is no chance of completion of trial in near future. The petitioner has also remained in jail for more than three years and nine months.

Taking into consideration the fact that the petitioner has already remained in jail for more than three years and nine months and there is no chance of completion of trial in near future, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Vigilance 1st, Patna in connection with Agamkuan P.S. Case No.44 of 2017.
