JUSTICE PARTHA SARTHY ORAL ORDER 09-09-2020 Heard learned counsel for the petitioner and learned counsel for the State, through video conferencing. The instant writ application has been filed for directing the respondents to make payment of the subsistence allowance, to vacate the suspension of the petitioner and for other reliefs.

A counter affidavit has been filed in the instant case on behalf of respondent no. 4.

On the matter being taken up, it is submitted by learned counsel for the petitioner that during pendency of the instant application, the petitioner received the subsistence allowance. Further, the departmental proceeding which was

Patna High Court CWJC No.3840 of 2020(4) dt.09-09-2020 2/2 initiated against the petitioner has concluded and an order of punishment has been passed against him. He seeks liberty to challenge the said order of punishment.

In view of the above, without going into the merit of this application, the instant application is dismissed as withdrawn with liberty to the petitioner to challenge the order of punishment in accordance with law.
