The petitioner apprehends his arrest in Sabour P.S. Case No. 51 of 2014 registered under Sections 419 and 420 of the Indian Penal Code and Section 10 of the Bihar Examination Act. The allegation against the petitioner is that in his place, Ajay Kumar was appearing at the matriculation examination.

Learned counsel for the petitioner submits that the petitioner is innocent and he has got no criminal antecedent. It appears that the petitioner set up Ajay Kumar to appear at the matriculation examination in his place. Hence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

The petitioner is directed to surrender in the court

Patna High Court Cr.Misc. No.33026 of 2014 (2) dt.09-02-2015 2/2 below within four weeks from today and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner without being prejudiced by this order. (Prabhat Kumar Jha, J) Dilip/- U T
