JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-05-2015 Heard learned counsel for the petitioner, learned A.P.P. for the State as well as learned counsel for the complainant. The petitioner apprehends his arrest in a case under Sections 498(A), 406, 494 of the Indian Penal Code. The complainant herself alleged that she is a widow lady and got one child. She came in contact with the petitioner, who assured to marry with her. The complainant became pregnant but the petitioner got her aborted. It is alleged that the petitioner began to demand more and more money and also solemnized marriage with one Amrita Kumari. Learned counsel for the petitioner submits that the entire allegation is false and concocted. The petitioner never solemnized marriage with the complainant at any point of time.
Patna High Court Cr.Misc. No.15145 of 2015 (2) dt.13-05-2015 2/2 On the other hand, learned counsel for the complainant submitted that the petitioner solemnized marriage with the complainant and, hence, the petitioner does not deserve anticipatory bail.
Considering the facts aforesaid and the fact that the complainant herself stated in her complaint petition that the petitioner assured to marry with her and she started living with the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate (East), Muzaffarpur in Complaint Case No. 2030/2013, corresponding to Trial No. 2013/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
