JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 19-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Kanti (Muzaffarpur) P.S. Case No. 687 of 2022, registered for offence punishable under Sections 30(a), 32(i), 32(ii), 36, 41 (i) of the Bihar Prohibition and Excise Act.

The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot, nothing was recovered from his possession and the persons, who were arrested at the spot and from whose vehicle 405 litres of illegal liquor have been recovered, have been granted bail by the coordinate Benches of this Court in Cr. Misc. Nos. 4883 and 8309 of 2023. The petitioner is under custody since 03.12.2022. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on

No.14008 of 2023(2) dt.19-05-2023 2/2 bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Court No.-II, Muzaffarpur in connection with Kanti (Muzaffarpur) P.S. Case No. 687 of 2022, subject to the following condition:- "Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other cases except the present one and the cases mentioned in paragraph no. 3 of the bail petition, his bail bond shall not be accepted."
