JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 23-07-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Parsa P.S. Case No. 115 of 2013 registered under Sections 302 read with 34 of the Indian Penal Code.

It is contended that save and except wild suspicion and hypothetical presumption, there is no material to connect the petitioner with the alleged offence. He has further contended that the post mortem report of the deceased would show that he died on account of electric shock.

On the other hand, learned counsel for the State has

No.13915 of 2015 (3) dt.23-07-2015 2 / 2 submitted that though there is no specific allegation against the petitioner, it has come in course of investigation that there was an ongoing dispute between the parties. The impugned order passed by the court below would show that only a suspicion has been raised against the petitioner.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Parsa P.S. Case No. 115 of 2013 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
