Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354D, 504/34 of the Indian Penal Code and 3(1) (xi) of the S.C./S.T.(Prevention of Atrocities) Act.
The prosecution case is that the informant Anjani Kumari was coming with her friend Annu Kumari from the school, when the petitioner started teasing. On protest being made the accused persons abused and assaulted the friend of the informant Annu Kumari .
It is submitted by the learned counsel for the petitioner that in 2012 the uncle of the petitioner Sheo Muni Singh lodged Chainpur P.S. Case No. 123 of 2012 against the informant's father, hence as retaliatory measure accusation
Patna High Court Cr.Misc. No.9338 of 2016 (2) dt.01-03-2016 has been levelled with malicious intention. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Lodging of the case from the petitioner's side at earlier point of time constitutes ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Chainpur P.S. Case No. 14 of 2016, pending in the court of learned Additional Chief Judicial Magistrate, Bhabua (Kaimur).
With this observation this application is disposed of.
