JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 This application, for grant of anticipatory bail, arises out of Madanpur P.S. Case No. 136 of 2014, disclosing offences under Sections 147, 148, 149, 341, 323, 337, 353, 307/124(A) of the Indian Penal Code, Section 27 of the Arms Act and Section 3/ 4 of the Explosive Substance Act and Section 17 of C.L.A. Act.

Allegation against the petitioners is of waging war against the Government and further participation in a mob pelting stones on the police party.

Submission of learned counsel for the petitioners is that they have no criminal antecedent and have falsely been

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S. Case No. 136 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
