JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-07-2022 Heard learned counsel for the petitioners and learned A.P.P for the State through video conferencing. The petitioners apprehend their arrest in Excise Case No. 04 of 2022, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. On secret information a raid was conducted and total 16 litres of country made liquor and 8 litres of foreign liquor have been recovered from the field situated in Passi Tola of Manjhagarh, Purani Bazar.

Patna High Court CR. MISC. No.13847 of 2022(2) dt.15-07-2022 2/2 It is submitted that nothing has been recovered from conscious possession of petitioners and only on suspicion they have been accused in this case. Petitioners have got clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge Iv-cum-Special Excise Judge Court No. 2, Gopalganj in connection with Excise Case No. 04 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
