ANJANA MISHRA ORAL ORDER 10-05-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners, being father and son, are apprehending their arrest in connection with Jamo Bazar P.S. Case No.59 of 2015 for allegedly having committed the offences under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the main allegation is against son-in-law of Petitioner No.1, who is alleged to have given a Chaku blow on the informant. So far as the present petitioners are concerned, though they had also attacked, no injury was found on the person of the informant. It is submitted that dispute is going on between the wife and

Patna High Court Cr.Misc. No.10159 of 2016 (2) dt.10-05-2016 2/2 younger brother of the informant, for which a case under Section 498A of the Indian Penal Code has been filed implicating all members of the family and the present case is only a sequel to the same.

Considering the aforementioned facts and circumstances and that Petitioner No.1 is having one criminal antecedent whereas as Petitioner No.2 has a clean past and also keeping in view the fact that injuries have not been found to be present on the person of the informant, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Jamo Bazar P.S. Case No.59 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
