Petitioner apprehends his arrest in Choraut P.S. Case No. 80 of 2019 registered for the offence under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner alongwith three other accused persons are alleged to have assaulted the informant, while he alongwith his companion was coming home, as a result of which, the informant sustained serious injury.

It is submitted on behalf of petitioner that there is general and omnibus allegation. No specific overt act has been alleged against this petitioner.

However, learned A.P.P. for the State has vehemently

Patna High Court CR. MISC. No.11099 of 2020(5) dt.01-12-2020 2/2 opposed the bail application and submitted that there is specific allegation against this petitioner that he alongwith other three accused have assaulted informant and his companion by fists and bricks and caused multiple injury and as per injury report, the doctor has also opined that the injury is grievous in nature. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the bail application is rejected. (Prabhat Kumar Singh, J.) anay/- U T
