JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-02-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 323 and 504 of the Indian Penal Code.
The basic accusation is of torture.
Learned counsel for the petitioner submits that the petitioner admits his marriage with the complainant and is ready to keep the complainant as wife with full dignity and honour. A statement to that effect has been made in para 2 of the
Patna High Court Cr.Misc. No.7987 of 2016 (2) dt.22-02-2016 2/2 supplementary affidavit which reads as follows:- "That the petitioner is ready to keep the complainant with full dignity and honour."
It appears from the impugned order and admitted by learned counsel for the petitioner that only bailable warrant of arrest has been issued.
In the circumstances, let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Complaint Case No. 707 of 2014 pending in the court of learned JM, 1st Class, Muzaffarpur.
Accordingly, the application is disposed of.
