Mr. Anil Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 16-02-2023 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the informant as well as learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code.

The prosecution case, in brief, is that on 08.09.2021 at about 2:00 PM the informant was going to Bank along with his wife Sulekha Devi and when reached near the house of one Fantus Sah, Mani Sah came and dragged the hand of his wife and pushed her on the earth and called to Fantus, who assaulted his wife by means of iron rod with an intention to kill her and in the meantime other accused persons namely Mukesh Sah, Dipak Sah and Renu Devi also came armed with khanti, spade and lathi

Patna High Court CR. MISC. No.13243 of 2022(4) dt.16-02-2023 2/2 came there and badly injured his wife due to which the wife of the informant died.

Learned counsel for the petitioner outrightly submits that all the prosecution witnesses have been examined and the statement of the accused under Section 313 of the Cr. P.C. has also been recorded.

Considering the aforesaid facts , I am not inclined to enlarge the petitioner on bail in connection with Kahalgaon (Rashalpur) P.S. Case No. 598 of 2021 pending in the Court of learned Judicial Magistrate 1st Class, Bhagalpur. Prayer is refused.

However, the learned Trial court is directed to expedite the trial at the earliest.
