JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-05-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor representing the State. The prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 29.01.2018 passed by a coordinate Bench of this Court in Cr. Misc. No. 49148 of 2017. The petitioner has again come up before this Court seeking a revisit to the order on the ground of some observations of the Sub-Divisional Police Officer regarding lack of appropriate evidence suggesting complicity of the petitioner and that the issue is related to embezzlement of Rs. 93,000/- only which the petitioner is ready to deposit under protest and subject to his rights and contentions later.

However, both the grounds do not weigh with this

Patna High Court CR. MISC. No.22745 of 2021(2) dt.25-05-2022 2/2 Court for revisiting the order dated 29.01.2018 whereby the prayer for anticipatory bail of the petitioner has been rejected. The prayer for anticipatory bail of the petitioner is thus rejected.

However, if the petitioner surrenders before the court below and seeks bail, the grounds raised here would be considered by the court below and an appropriate order shall be passed with reasons.
