At the out set, it is submitted by the learned counsel for the petitioner that due to efflux of time, the application has become infructuous as the challenge in the present application preferred under Section 482 of the Code of Criminal Procedure, was to the order by which cognizance of the offence was taken and by now charges have already been framed and evidence is going on.

In that view of the matter, he seeks leave to withdraw the present application.

Leave is granted.
