Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366A, 376/34 of the Indian Penal Code.
It is alleged that when the informant went outside to ease, co-accused Bablu and the petitions forcibly took her to marry. When she raised alarm then Bablu closed her mouth and forcibly took her to Baria Chowk. It is alleged that subsequently eight persons came, they assaulted Bablu and thereafter they ravished her one by one. In 164 Cr.P.C. statement she identified co-accused Firoz and Khurshid. It is submitted by the learned counsel for the petitioners that accusation of committing rape is not against
Patna High Court Cr.Misc. No.15018 of 2015 (2) dt.12-05-2015 the petitioners and the persons who were identified by the victim have been granted regular bail vide Cr. Misc. No. 18482 of 2014.
Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Jokihar P.S. Case No. 101 of 2013, pending in the court of learned Chief Judicial Magistrate, Araria.
With observation above this application is disposed of.
