JUSTICE SHIVAJI PANDEY ORAL ORDER 24-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual Court proceeding. In the present case, the petitioner is seeking bail in connection with Warisaliganj P.S. Case No. 404 of 2019, registered for offence punishable under Section 363 of the Indian Penal Code.

Allegation against the accused persons is to have enticed away the minor daughter of the informant, aged about 13 years, however, counsel for the petitioner submits that the petitioner is not named in the FIR and during course of investigation, the name of the petitioner has come on the basis of mobile number. In her statement under Section 164 Cr.P.C., she has stated that she has gone of her own will with the petitioner. It is urged that the petitioner is in judicial custody
