JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Samastipur (M) P.S. Case No. 210 of 2018, registered for the offences punishable under Sections 120B, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the accused persons, including the petitioner is of causing death of father of the informant. Submission of learned counsel for the petitioner is that FIR itself shows that informant is not an eye-witness to the occurrence and only on suspicion he has been made accused and similarly situated co-accused person has been granted privilege of anticipatory bail vide order dated 29.10.2018 in Cr.Misc.No. 53128 of 2018.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Samastipur, in connection with Samastipur (M) P.S. Case No. 210 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
