This application, for grant of anticipatory bail, arises out of Gopalganj Town P.S. Case No.456 of 2015, disclosing offences under Sections 364A, 363 and 120B of the Indian Penal Code.
Learned counsel for the petitioner has submitted the petitioner was not named in the First Information Report and his name has surfaced in this case merely on the basis of confessional statement of a co-
Patna High Court Cr.Misc. No.19312 of 2016 (2) dt.18-05-2016 2/2 accused.
Learned counsel, appearing on behalf of the informant, on the other hand, has submitted that the trial of the case has already been commenced.
Considering the gravity of the offence, I am not inclined to grant the petitioner the privilege of anticipatory bail.
This application is, accordingly, rejected.
The petitioner, abovenamed, is directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant anticipatory bail.
