The petitioners seek bail in connection with Nagar (Lohiya Nagar O.P.) P.S. Case No. 664 of 2017 registered under Sections 30(a) of Bihar Excise Amendment Act -2016. 61.920 liters of foreign liquor is said to have been recovered from the maize field of Bhola Mahto and three persons including the petitioners were apprehended.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their conscious physical possession. Petitioners have neither any concern with the place of occurrence nor with the seized liquor nor

Patna High Court Cr.Misc. No.8725 of 2018 (2) dt.17-02-2018 2/2 with the Bhola Mahto. They have also no concern with any trade of liquor. They have been falsely implicated in this case due to dirty village politics by planting the aforesaid recovery from their possession. They have been languishing in custody since 30.11.2017.

In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-7th, Begusarai-cum-Special Judge, Begusarai in connection with Town (Lohiya Nagar O.P.) P.S. Case No. 664 of 2017.
