JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, who is in custody since, 23.12.2019, seeks bail in connection with Excise Gr. No. 1119/2019 (CIS 1306/2019) arising out of Brahampur (Krishnabrahm) P.S. Case No. 551/2019, dated 27.11.2019, instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act 2018 (hereinafter referred to as 'Excise Act').

It appears that on secret information that petitioner and two others have been dealing in liquor and on the date of information, they had brought liquor to their houses, the house of one Santosh Ram was raided and from there, 26.100 litres of liquor was recovered.

There does not appear to be any recovery from the house of the petitioner.

Apart from this, it has been submitted that the petitioner was earlier also made an accused in a case of similar nature in which he has been granted bail. Regard being had to the aforestated facts, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge IIcum-Special Judge (Excise), Buxar in connection with Excise Gr. No. 1119/2019 (CIS 1306/2019) arising out of Brahampur (Krishnabrahm) P.S. Case No. 551/2019. The application stands allowed.
