The petitioner seeks bail in S.T. No.360 of 2017, arising out of Samastipur (Muffasil) P.S. Case No.20/2017, registered under Sections 302 of the Indian Penal Code. Learned counsel for the petitioner submits that there is no eyewitness of the occurrence but it appears that the informant himself alleged that the newly born child was thrown in septic tank by the petitioner.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. The Trial Court is directed to hold the trial on day to day basis and conclude the same within 9 months from the date of

Patna High Court Cr.Misc. No.15553 of 2018 (2) dt.02-05-2018 2/2 receipt of this order.

The Superintendent of Police, Samastipur is directed to ensure the attendance of the prosecution witnesses in the trial court in S.T. No.360 of 2017, arising out of Samastipur (Muffasil) P.S. Case No.20/2017, so that the trial must be concluded within 9 months.

Let a copy of this order be sent to the Trial court as well as Superintendent of Police, Samastipur for information and needful.
