The petitioner is languishing in custody since 24.04.2018 in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

The prosecution case is that the informant's staff, namely, Mithilesh Kumar was robbed of a cash amount of Rs.2,00,000/- and a mobile phone by three unknown accused persons on a motorcycle, on gun point, leading to the registration of FIR against three unknown persons. It is further alleged that the name of the petitioner sprang up on the confessional statement of co-accused, Dilshad. It is submitted by learned counsel for the petitioner that there is no recovery from the conscious physical possession

Learned APP for the State submits that the name of the petitioner sprang up on the confessional statement of coaccuses, Dilshad. Considering the fact that there is no recovery from the conscious physical possession of the petitioner, investigation has already been concluded and till date, petitioner has not been put on T.I. parade, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Narpatganj P.S. Case No.320 of 2017.
