The petitioner has prayed for bail in connection with Minapur P.S. Case No. 33 of 2020 registered for the offence punishable under sections 363/34 of the Indian Penal Code. As per allegation in the FIR, son of the informant proceeded towards his nanihal but he did not reach there. There is strong apprehension of his kidnapping the informant's son by co-accused Sogarath Rai and Babloo Paswan due to old differences.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not named in the FIR. During investigation, it came to light that victim was having friendship with antisocial element and was

Patna High Court CR. MISC. No.13242 of 2022(3) dt.02-01-2023 2/2 indulged in business of illicit liquor and six cases are pending against him. Except confessional statement of the petitioner, there is no absolute material against him. Petitioner is in custody since 01.06.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in connection with Minapur P.S. Case No. 33 of 2020.
