JUSTICE ARUN KUMAR ORAL ORDER 29-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kundwachainpur P.S.Case No. 163 of 2017 registered under Section 414 of Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is that 518 bottles of Nepali liquor in total 155 litres approximately was recovered from the possession of the petitioner. Submission is that recovery is from an auto rickshaw and the driver escaped away but the petitioner being passenger was apprehended and he is not the owner of the auto rickshaw and is in custody since 09.11.2017 and has no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely, Munna Kumar is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise,
